驰名商标的相对保护指在同类商品的范围内保护驰名商标的专用权。
如法国商标法规定,商标注册并不能阻止他人使用同一商标于不同类商品上,同时规定,一切尚未注册的驰名商标,可以成为相同或相似的其他商标取得注册的障碍。
但法国在具体的判决上对驰名商标却实行较广泛的保护,其立论基础是,被侵害的商标如果是驰名商标,如果驰名商标被冒用于不同商品上,将使消费者把这些商品误认为是驰名商标权人的新产品而发生混淆。因此,将驰名商标冒用在不同商品上也属侵权行为,可对之提起诉讼。但这种扩大了的保护有一定限度,即以足以使消费者发生混淆的商品为范围,如果两种商品之间风马牛不相及,根本不致产生混淆,则不可谓侵权。
从根本上讲,法国对驰名商标还是实行相对保护。如法国最高法院曾要求日本东洋工业公司使用“马自达”(Mazda)商标时,应注明“汽车”以区别于美国索恩电气公司的同名“马自达”商标。
德国对驰名商标的保护也局限于“同一商品与同类商品”,驰名商标是否受到侵害,以及商标是否受到保护,应由两商标的近似程度和使用商标的商品是否同一或同类加以判断,对于驰名商标使用于完全不同的商品上,德国商标法未加限制。
